A viewer wanted to know if he could be charged with a crime if, after firing two rubber bullets at an attacker, he killed the attacker with a live round.
The clear implication here is that by loading rubber bullets into your defensive handgun, you are showing any prosecutor that you have done all you can to avoid using deadly force.
The truth of the matter is that you won’t be charged because of the type of bullets you use, but based on the totality of the circumstance. If you are facing a deadly threat, you can use deadly force to defend yourself.
My question is, “Why would you use less than lethal force against a deadly threat?” That is not a good plan. It is your personal choice, but I advise against it.

If you are facing a deadly threat, please use the appropriate level of force to defend yourself. I never want to hear that a USCCA member died firing rubber bullets at an attacker carrying a real weapon.
