USCCA Statement on House Judiciary Markup of Pistol Brace Resolution

West Bend, WI –​ The U.S. Concealed Carry Association (USCCA) released the following statement on lawmakers in the U.S. House Judiciary Committee completing a bill markup of a Congressional Review Act that would nullify the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF)’s new final rule redefining a firearm with an attached stabilizing brace as a short-barreled rifle.  

“The USCCA, on behalf of our 750,000 members nationwide, commends Reps. Richard Hudson and Andrew Clyde for introducing this vital legislation to rein in the ATF’s blatant overreach and defend the rights of millions of Americans. Today’s bill markup, under the leadership of House Judiciary Chairman Jim Jordan, demonstrated how out of step the ATF and Director Steve Dettelbach are with the countless law-abiding gun owners, many of whom are disabled veterans, who use pistol braces to safely use a firearm.  The USCCA strongly supports this congressional oversight of the ATF’s reckless rulemaking that threatens responsible gun owners,” USCCA Managing Director of Government Affairs Katie Pointer Baney said. 

The new final rule, released by the ATF earlier this year, jeopardizes the Second Amendment rights of millions of Americans by requiring millions of gun owners to obtain a special registration, surrender, or destroy their stabilizing brace by May 31, 2023 or face severe criminal penalties. The Congressional Review Act marked up today would repeal the ATF’s rule, if passed.

“When the ATF Director publicly says, ‘I’m not a firearms expert,’ then it’s ludicrous that his agency is proceeding to re-classify millions of firearms as illegal.  We hope the full House swiftly considers and passes this important resolution repealing the ATF’s unconstitutional rule,” concluded Pointer Baney.
