Brian had never been arrested in his life. He barely had a traffic record.

Less than 24 hours after trying to help his ex-wife, he was charged with first-degree murder ... a charge that, in North Carolina, meant no bond, no trial date, and potentially the rest of his life behind bars.

Brian was 42, a 20-year U.S. Army veteran with no criminal history.

The morning began with a text from his ex-wife: her house had burned down overnight, and she was on his porch with a black eye and bruising on her throat…

Her ex-boyfriend had assaulted her, she later told police, in a fire that investigators considered suspicious in origin.

Brian called the sheriff's department, was redirected to the fire marshal, and learned her dog was still hiding under the burned trailer. He agreed to retrieve it, bringing his 8-year-old daughter for the drive.

"It occurred to me that it might not be safe to go over there, that he might be there," Brian said of the ex-boyfriend. "However, it also occurred to me that if I had assaulted a woman and committed arson, I wouldn't stick around."

They were salvaging belongings from the trailer when the man appeared, smoking, nonchalant. Brian's ex-wife recognized him instantly: "That's him! That's the man!"

Brian stepped between them…

When the man tried forcing his way past, Brian knocked him down, then again when he charged the porch steps a second time. The man ran to a Suburban, grabbed a steel pipe, and came back at a run.

Brian drew his Ruger LCR .38 Special from his truck's center console.

"I don't want to," he told the man, who'd asked if he intended to shoot. "Just go away."

The man lunged with the pipe raised, and Brian fired once.

He called 911 himself, moved his truck to clear the way for the ambulance, and was handcuffed at the scene without protest. The attacker died en route to the hospital. Three hours and fifteen minutes after the first 911 call, Brian was arrested for first-degree murder.

In North Carolina, first-degree murder is a capital offense. Capital cases are not eligible for bond unless the district attorney chooses to prosecute the case as non-capital.

Attorney Kevin Marcilliat, of Roberts Law Group and a member of the USCCA Attorney Network, took the case.

"From the very moment that I got the case, I was, and continue to be, No. 1, shocked that he was charged, and No. 2, shocked that he was charged so quickly without much more investigation on a charge of first-degree murder," Marcilliat said. "In our state, you can get a first-degree murder warrant against someone without any consultation with the district attorney's office, without any say-so by a judge or anyone who possesses a law degree."

Marcilliat found that investigators had misjudged the distance between Brian and his attacker, and had leaned heavily on two on-scene witnesses whose accounts he called "somewhere between skewed and outright fabrications."

Brian spent 110 days in jail before bond was granted. 144 days after the incident, the district attorney called Marcilliat directly to dismiss the case as self-defense.

"You hope it never does, and you hope you're prepared if something like that does happen," Marcilliat said. "But if you are a concealed carry holder and you're exercising your own rights, you should not assume that the judicial system will understand immediately, or ever, that that's what you were doing."
